On Friday 26 March 2021, Harness Racing Victoria (HRV) Stewards inquired into the circumstances relating to the alleged theft of a Finntack jacket from the Garrards store located at Tabcorp Park Melton on 13 October 2020.
After consideration of evidence provided by licenced stablehand Jerry Glavas during an interview with HRV Stewards on 25 March 2021, Mr Glavas was issued with a charge under Australian Harness Racing Rule (AHRR) 231(2) which states:
A person shall not misconduct himself in any way.
The particulars of the charge being that at the Tabcorp Park trial meeting on 13 October 2020, Mr Glavas misconducted himself by taking possession of a Finntack jacket without paying for it, and failed to pay for it until he was contacted the following day.
Mr Glavas pleaded guilty to the charge.
After considering submissions on penalty, Mr Glavas was fined the sum of $500, with $250 of that amount suspended for a period of 12 months.
In arriving at this penalty Stewards were mindful of:
- Mr Glavas' excellent record;
- The circumstances of the rule breach;
- Mr Glavas' personal circumstances;
- Mr Glavas' guilty plea and remorse;
- General and specific deterrence.
